Terms of Service

1. Acceptance

By accessing or using any part of the Service, you agree to be bound by these Terms of Service and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these terms, and "you" refers to both you and the organization.

WeighStation publishes carrier intelligence derived from publicly available FMCSA data. The Service includes:

3. Not a Consumer Reporting Agency

WeighStation is not a consumer reporting agency as defined by the Fair Credit Reporting Act (FCRA), 15 U.S.C. § 1681 et seq. The WeighStation Score and all report content describe the safety and compliance record of commercial motor carriers — legal business entities regulated by the FMCSA — not individual consumers. Reports may not be used as a factor in determining any individual’s eligibility for employment, credit, insurance, housing, or any other purpose regulated by the FCRA.

If a carrier is operated by an individual (e.g., an owner-operator), you are solely responsible for ensuring your use of WeighStation data complies with all applicable laws, including the FCRA, before using any report as a basis for employment or contracting decisions involving that individual.

4. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Service or purchase any report.

5. Purchases and Billing

Prices are listed in U.S. dollars and are exclusive of any applicable taxes. We accept payment via Stripe. By purchasing, you authorize us (through Stripe) to charge your payment method for the amount shown at checkout. Prices may change at any time, but changes will not affect purchases already completed.

Reports are one-time transactions. Each report covers a single USDOT carrier at the time of purchase. Reports are delivered by email link and via the success page immediately following successful payment, typically within minutes. Reports are generated from data current as of the date of purchase.

6. Refund Policy

All sales are final. Because reports are digital products delivered on purchase, we do not offer refunds or cancellations as a matter of policy. If you believe a purchase was made in error, a report failed to deliver, or there is a billing dispute, email inquiries@weighstation.io and we will review your request in good faith on a case-by-case basis.

7. License to Reports and Content

Subject to your compliance with these terms, WeighStation grants you a limited, non-exclusive, non-transferable, non-sublicensable license to use the reports and content you purchase for your internal business use — including internal diligence, internal decision memos, and sharing within your own organization.

You may quote short excerpts (fewer than 200 words) in external materials with attribution to “WeighStation.” Use of charts or tables in external presentations is permitted with visible attribution.

The underlying carrier data in our reports originates from public sources — principally the FMCSA Open Data Program (data.transportation.gov), including the Company Census File, SMS AB PassProperty, Crash File, InsHist All With History, AuthHist All With History, and OOS Orders datasets. That underlying data is not proprietary to WeighStation and is in the public domain.

The following are the proprietary property of WeighStation: our report layouts and editorial structure, our aggregated tables and cross-dataset joins, our computed metrics and scores (including the WeighStation Score and all component scores), our written analysis and commentary, our methodology descriptions, and all trademarks including “WeighStation,” “WeighStation Score,” and the WeighStation wordmark and scale logo. These are protected by copyright and trademark law. All rights not expressly granted are reserved.

10. Data Accuracy and Carrier Disputes

Data Accuracy

WeighStation is a research publisher, not a licensed advisor. Our reports describe and interpret publicly available FMCSA data. We do not provide legal, regulatory, safety, employment, or investment advice. Nothing in our reports constitutes a recommendation to enter into or avoid any contract, transaction, or business relationship.

FMCSA data is known to contain errors, omissions, reporting lags, and duplicate records. We make reasonable efforts to deliver data refreshed from primary sources on a documented cadence, but we do not warrant that any data point is complete, current, or free of error. Users making material decisions are solely responsible for independently verifying any fact they rely on.

Carrier Dispute Process

If you are a carrier and believe your WeighStation Score or report data is materially inaccurate due to an error in the underlying FMCSA source data, you should first file a DataQ dispute directly with FMCSA at dataqs.fmcsa.dot.gov. WeighStation derives scores from FMCSA data; corrections to the source propagate to our platform on the next scheduled data refresh.

To notify WeighStation of a disputed data point, email inquiries@weighstation.io with your USDOT number, the specific data element in dispute, and any supporting documentation. We will review within 10 business days and update our data if the underlying FMCSA source has been corrected.

11. Disclaimer of Warranties

THE SERVICE AND ALL REPORTS, DATA, AND CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WEIGHSTATION DISCLAIMS ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND QUIET ENJOYMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WEIGHSTATION AND ITS OWNERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, BUSINESS INTERRUPTION, OR DAMAGES ARISING FROM RELIANCE ON CARRIER SAFETY DATA — ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO WEIGHSTATION IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

13. Indemnification

You agree to indemnify, defend, and hold harmless WeighStation and its owners, employees, and contractors from any third-party claim, demand, loss, or expense (including reasonable attorney fees) arising out of (a) your violation of these terms, (b) your misuse of the Service or content, (c) your violation of any law or third-party right, or (d) any decision you make in reliance on WeighStation data without independent verification.

14. Termination

We may suspend or terminate your access to the Service at any time for violation of these terms or to comply with legal process. Sections that by their nature should survive termination will survive — including intellectual property, disclaimers, limitation of liability, indemnification, and governing law.

15. Governing Law and Disputes

These terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles. Any dispute arising out of or relating to these terms or the Service will be brought exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to personal jurisdiction there.

Before filing a formal dispute, you agree to first contact us at inquiries@weighstation.io and attempt to resolve the matter informally for at least thirty (30) days.

16. Changes to These Terms

We may update these terms from time to time. The “Effective” date above will be updated when changes are made. Continued use of the Service after a change constitutes acceptance of the revised terms.

17. Miscellaneous

If any provision of these terms is found unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right is not a waiver of that right. You may not assign these terms without our written consent. These terms, together with the Privacy Policy, constitute the entire agreement between you and WeighStation regarding the Service.
